Bankruptcy

We represent individuals and businesses in bankruptcies under Chapters 7, 11, and 13.  Our representation has included representing individual debtors in Chapter 7 liquidations and 13 wage earner plans, as well as representation of debtors, creditors, and committees in Chapter 11 business reorganization cases.

Our representation of creditors includes protecting their rights in a bankruptcy proceeding.  Creditors must take an active role and participate in court-approved reorganization and repayment plans, including making timely objections in an appropriate manner.  Otherwise, the creditor may find itself left out of the plan with no recourse to collect its debt. 

We also assist individual and corporate creditors in debt collection matters in the absence of bankruptcy and can help the creditor obtain relief through instruments such as liens, garnishments, and attachments.

IRS Representation

In dealing with the Internal Revenue Service (IRS), it is essential that prompt and proper steps be taken to secure your rights, or your right to assert them may be waived.  We help clients resolve their IRS claims through offers in compromise, settlements, penalty abatement, and other means available. 

Tax Court Litigation

The United States Tax Court hears disputes between taxpayers and the Internal Revenue Service over alleged tax deficiencies and other tax determinations, including statutory interest determinations and failure of the tax commissioner to abate interest.  Attorneys' fees and costs may sometimes be awarded to a prevailing party in a Tax Court case, and we can seek those awards when appropriate.
